The system does not perform any analysis of the Applicant's face, voice, facial expressions, gestures or other biometric characteristics, does not perform emotion recognition within the meaning of Article 3(39) of the AI Act, nor biometric identification or categorisation;
b) Applicant Content. Any content that the Applicant uploads into the Electronic System, in particular a CV, cover letter, profile photo, work preferences, answers to questions in the selection process, and messages sent to Clients;

b) immediately inform Jobiflow at the e-mail address pursuant to Art. 1.7 of the Terms of any suspicion of unauthorized access to their account.
Jobiflow is not liable for damage arising from the misuse of the Applicant's login credentials by third parties if the misuse occurred as a result of the Applicant's breach of obligations under Article 3.5 of the Terms; this is without prejudice to the Applicant's rights that cannot be excluded under applicable law.
3.6. Proper use of the Electronic System requires a device meeting the technical requirements under Article 8.1 of the T&Cs (a web browser with enabled technical cookies, local storage and JavaScript, and an internet connection).
4. APPLICANT PROFILE AND CONTENT
4.1. After Registration, the Applicant may create and manage their Applicant Profile, which serves as a presentation of their qualifications and job preferences to potential employers (Clients).
4.2. The Applicant may enter into their Profile in particular:
a) basic identification and contact details (name, surname, e-mail, phone, address),
b) CV and cover letter,
c) information about education, work experience, skills and language proficiency,
d) profile photo, and
e) job preferences (preferred position, location, type of employment, salary expectations).
4.3. The Applicant is responsible for the truthfulness, completeness and up-to-dateness of the Applicant Content. By uploading Content into the Electronic System, the Applicant confirms that:
a) they have the right to publish and make this content available to Jobiflow and Clients,
b) the content does not infringe the rights of third parties (in particular copyrights, the right to protection of personality, or the right to protection of personal data of third parties), and
c) the content is true and not misleading.
4.4. The Applicant may not upload into the Profile or the Electronic System any content that:
a) is untrue, misleading or deceptive (e.g. falsification of documents relating to education, work experience or references),
b) is offensive, obscene, discriminatory or unethical,

d) contains personal data of third parties without their knowledge and consent,
e) contains viruses, malicious code or other technically harmful content, or

4.5. By uploading the Applicant Content into the Electronic System, the Applicant grants Jobiflow a free, non-exclusive and worldwide license to use it to the extent necessary for providing the Services, in particular for:
a) displaying the Applicant Profile to Clients to whose Ads the Applicant responds,
b) processing the Content through AI Functions under Article 6 of the Terms, and in the case of the AI Avatar Interview only if the Applicant has expressly consented to it, and
c) technical storage, backup and reproduction of the content within the operation of the Electronic System.
The license is granted for the duration of the user account and for 1 year after its cancellation, unless legal regulations (in particular GDPR) require earlier termination of use; this is without prejudice to Article 12.2 of the Terms.
4.6. The Applicant may control, through their account settings, which parts of the Profile are visible to Clients. Jobiflow does not guarantee that hidden parts of the Profile will in every case actually be invisible to all Clients (e.g. if a Client has a direct link that the Applicant themselves shared).
5. RESPONDING TO ADS
5.1. The Applicant may respond to Ads through the functionalities of the Electronic System by sending their Profile and/or CV to the relevant Client. By sending a Response, the Applicant acknowledges that the relevant data from their Profile will be made available to the Client who published the Ad.
5.2. In the course of processing the Response, Jobiflow shall make the Candidate Profile, including the CV and other Candidate Content, available to the Client who owns the Advertisement. This disclosure is necessary for the performance of the Agreement, or is carried out on the basis of the legitimate interest of Jobiflow and the Client pursuant to Article 6(1)(b) and (f) GDPR, as described in more detail in the Personal Data Processing Policy; the Candidate has the right to object to processing based on legitimate interest pursuant to Article 21 GDPR.
5.3. Jobiflow is solely the operator of the platform that facilitates contact between the Candidate and the Client. The Client is solely responsible for the course of the selection procedure, communication with the Candidate, the decision to accept or reject, and compliance with labor law regulations (including anti-discrimination regulations).
5.4. Jobiflow does not guarantee that by submitting a Response the Candidate will obtain a job offer, an invitation to an interview, or any feedback from the Client. Jobiflow is not responsible for the Client's acts or omissions during the selection procedure.
5.5. Jobiflow retains the history of the Candidate's Responses in the Electronic System for a period of 3 years from the Candidate's last activity. The Candidate has access to the history through their account.
6. AI FEATURES AND AI AVATAR INTERVIEW
6.1. The Electronic System uses AI Features to the extent set out in the T&C, namely AI job ad creation, AI job ad translation, AI interview scheduling, and AI Avatar Interview. AI job ad creation, AI job ad translation, and AI interview scheduling serve Clients for recruitment preparation and organization and do not evaluate or filter Candidates. The AI Avatar Interview is a high-risk artificial intelligence system
6.2. within the meaning of point 4
6.3. (a) of Annex III to the AI Act.
6.4. If the Candidate decides to take part in the first round of the selection procedure in the form of an AI Avatar Interview, the virtual avatar will ask them questions predefined by the Client, an audiovisual recording of the response and its text transcript will be made, and the system will compare exclusively the content of the transcript with the Client's model answer, resulting in a percentage matching score. Before the interview begins, the Candidate is always clearly informed that they are communicating with artificial intelligence and not with a physical person. The system does not analyze the Candidate's face, voice, facial expressions, tone of speech, fluency of speech, or other biometric or behavioral characteristics and does not perform emotion recognition.
6.5. The AI Avatar Interview takes place solely on the basis of the Candidate's express consent pursuant to Article 6(1)(a) and Article 22(2)(c) GDPR, granted before the interview begins through the consent interface of the Electronic System. The Candidate always has access to an equivalent alternative form of the first round of the selection procedure without the use of artificial intelligence, and refusal or withdrawal of consent has no negative consequences for the assessment of their candidacy. Consent may be withdrawn at any time by the procedure specified in the consent form or at the email address pursuant to Article 1.7 of the Terms.
6.6. In relation to the AI Avatar Interview, the Candidate has the right that no decision on their elimination from the selection procedure be made solely on the basis of the percentage matching score without review of their answer by a natural person on the Client's side, the right to request human review of the result, the right to express their own view on the result, and the right to contest the result (Article 22(3) GDPR). The Candidate exercises these rights with the Client or through the contact pursuant to Article 1.7 of the Terms; in the same way, they may request a comprehensible explanation of how the output of the AI Feature affected the outcome of their selection procedure.
d) Jobiflow takes measures to prevent the discriminatory effect of AI models:
a) The AI Features do not use as input parameters special categories of personal data pursuant to Article 9 GDPR (data concerning race, ethnic origin, political opinions, religion, sexual orientation, health status, etc.),
b) AI models are regularly tested for the occurrence of systematic bias towards groups protected by anti-discrimination legislation, and the technical documentation of AI systems is maintained to the extent required by Article 11 and Annex IV of the AI Act. More detailed information on automated processing, including audiovisual recordings, retention periods, and the rights of the data subject, is set out in the Personal Data Processing Policy.
c) If Jobiflow processes the Candidate's personal data through AI Features on the basis of legitimate interest,
6.7. The Candidate has the right to object at any time on grounds relating to their particular situation in accordance with Article 21 GDPR.
7. RULES FOR USING THE ELECTRONIC SYSTEM
The Candidate is authorized to use the Electronic System solely for the purpose of searching for job opportunities and managing their Candidate Profile, in accordance with these Terms and applicable legal regulations.
7.1. The Candidate must not:

e) impersonate another person or entity, or
f) use the Electronic System to send unsolicited communications (spam) to Clients or other Candidates.
7.2. The Candidate is obliged to notify Jobiflow without delay at the email address pursuant to Article 1.7 of the Terms of any security deficiencies of the Electronic System of which they become aware. The Candidate undertakes to refrain from disclosing information about such deficiencies for a period of at least 60 working days from their notification to Jobiflow.
7.3. Jobiflow makes reasonable efforts to ensure the continuous availability of the Electronic System, but does not guarantee 100% availability. Jobiflow is entitled to temporarily take the Electronic System offline, especially for planned maintenance, updates, or resolution of security incidents. Jobiflow shall inform Candidates of planned outages longer than 60 minutes in an appropriate manner at least 24 hours in advance, if objectively possible.
7.4. Jobiflow is entitled to use any feedback provided by the Candidate for the purposes of further development of the Electronic System without the Candidate being entitled to any financial compensation.
8. RESPONSIBILITY OF JOBIFLOW AND LIABILITY FOR DEFECTS
8.1. Jobiflow is responsible for the proper technical functioning of the Electronic System. Jobiflow is not liable for:
a) the truthfulness and currency of the content of Advertisements published by Clients,
b) the course and outcome of the selection procedure conducted by the Client,
c) any decisions of the Client concerning the Applicant within the recruitment process,
d) the malfunction of the Electronic System caused by technical faults on the part of the Applicant or a third party (e.g. internet outage, incompatible browser), nor
e) inaccuracies in the outputs of AI Functions, which are for informational purposes and are not binding on the Client; this is without prejudice to the Applicant's rights under Article 6 of the Terms.
8.2. Jobiflow is liable to the Applicant for damages under the general provisions of the Civil Code. The Applicant's rights as a consumer, including claims for damages and claims under Article 82 GDPR, are neither excluded nor limited by these Terms.
8.3. Jobiflow is not liable for failure to fulfill obligations arising from these Terms if it was caused by circumstances excluding liability (force majeure), i.e. circumstances that arose independently of Jobiflow's will and which Jobiflow could not prevent (e.g. natural disasters, cyberattacks by third parties, power outages, measures by public authorities).
8.4. Jobiflow is liable to the Applicant for defects in the Electronic System as a digital service to the extent provided by the relevant provisions of the Civil Code on liability for defects in digital performance. The Applicant may raise a defect in accordance with Article 10 of the Terms; if Jobiflow does not remedy the defect within a reasonable period, the Applicant has the rights granted to them by legal regulations.
9. WITHDRAWAL FROM THE CONTRACT
9.1. The Applicant is entitled to withdraw from the Contract without giving any reason within 14 days from the date of its conclusion (Registration), by notice sent to the e-mail address under Article 1.7 of the Terms or by deleting the account in accordance with Article 12.1 of the Terms. Since use of the Electronic System is free of charge, withdrawal is not associated with a refund of any payments.
9.2. The Applicant's right to delete their account at any time under Article 12.1 of the Terms, and thereby terminate the Contract even after the period under Article 9.1 has expired, is not affected.
10. COMPLAINTS, CLAIMS AND DISPUTE RESOLUTION
10.1. The Applicant may submit a complaint or claim regarding the quality of the Services or the conduct of Jobiflow by e-mail to the address under Article 1.7 of the Terms or in writing to the address of Jobiflow's registered office. The submission must contain the Applicant's identification, a description of the subject matter, and the requested method of handling.
10.2. Jobiflow handles complaints and claims without undue delay, no later than 30 days from their receipt. Jobiflow informs the Applicant of the result of handling to the e-mail address from which the submission was sent, or to the address stated in the submission.
10.3. If the Applicant is not satisfied with the manner of handling or believes that Jobiflow has violated their rights, they have the right to submit a proposal to initiate alternative dispute resolution to an alternative dispute resolution entity pursuant to Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes. The alternative dispute resolution entity is in particular the Slovak Trade Inspection (www.soi.sk); the list of all entities is maintained by the Ministry of Economy of the Slovak Republic. A proposal may be submitted if Jobiflow responded negatively to the request for remedy or did not respond within 30 days of its sending.
10.4. Supervision over compliance with Jobiflow's obligations in the field of consumer protection is carried out by the Slovak Trade Inspection, SOI Inspectorate for the Trenčín Region, Hurbanova 59, 911 01 Trenčín.
10.5. These Terms are governed by the law of the Slovak Republic. Disputes between Jobiflow and the Applicant shall be decided by the courts of the Slovak Republic; this is without prejudice to the provisions of legal regulations on jurisdiction in consumer disputes in favor of the Applicant.
11. PROVISIONS RELATED TO THE DSA
11.1. The Electronic System is considered an intermediary service within the meaning of the DSA, and parts of it have the nature of an online platform. Jobiflow has established a single point of contact for service recipients and public authorities, available at the address of its registered office and at the e-mail address under Article 1.7 of the Terms; communication is possible in Slovak or English.
11.2. The Applicant may report the presence of illegal content in the Electronic System (e.g. illegal or discriminatory Advertisement) through the contact point under Article 11.1. The report must include an explanation of the reasons, precise identification of the content (especially the URL address), the name and e-mail address of the reporter (with exceptions under the DSA), and a statement of good faith as to the accuracy and completeness of the report. Jobiflow processes reports diligently, impartially, and objectively and informs the reporter of the result.
11.3. If Jobiflow imposes a restriction on the Applicant within the meaning of Article 17 of the DSA (in particular removal or restriction of the visibility of the Applicant's Content, suspension or deletion of the account due to illegal content or conflict with these Terms), it shall provide them with clear and specific reasoning, if it has their electronic contact details.
11.4. The Applicant has the right, within six months from receipt of the decision under Article 11.3, to file a free complaint against it through the contact point under Article 11.1; the complaint shall state an unequivocal identification of the challenged decision. The Applicant may also at any time initiate out-of-court dispute resolution before a certified out-of-court dispute resolution body (the list is maintained by the Council for Media Services) and has the right to обратиться to a court.
12. ACCOUNT DELETION AND TERMINATION OF THE CONTRACTUAL RELATIONSHIP
12.1. The Applicant may delete their user account at any time
12.2. directly in the account settings in the Electronic System or
12.3. by sending a request to the email address pursuant to Art. 1.7 of the Terms.
12.4. Deleting the account terminates the Agreement between Jobiflow and the Candidate. Jobiflow shall, without undue delay, no later than 30 days from the deletion of the account, delete the Candidate Profile and Candidate Content from the Electronic System, except for:
a) data whose retention is necessary to fulfill Jobiflow's legal obligation (e.g. tax and accounting regulations),
b) data necessary for proving, asserting or defending legal claims, for the duration of the limitation period, and
c) anonymized or aggregated statistical data from which it is not possible to identify a specific Candidate.
12.5. Jobiflow is entitled to delete or suspend the Candidate's account if:
a) the Candidate has breached these Terms, especially the prohibitions under Art. 4.4 or Art. 7.2 of the Terms,
b) the Candidate provided false identification data during Registration,
c) there is a reasonable suspicion of fraud, misuse of the Electronic System, or conduct contrary to law,
d) the Candidate breaches these Terms in another way and does not remedy the breach even within 7 days of being notified by Jobiflow, or
e) Jobiflow ceases operating the Electronic System.
12.6. Jobiflow shall inform the Candidate in advance by email about the deletion or suspension of the account pursuant to Art. 12.3(a) to (d), provide the Candidate with a justification pursuant to Art. 11.3 of the Terms, and, if this is possible and appropriate with regard to the severity of the breach, also a reasonable period for remedy.
13. CONFIDENTIALITY
13.1. If the Client expressly designates certain information as confidential within a specific selection procedure (e.g. non-public information about planned projects disclosed during an interview), the Candidate undertakes to keep such designated information confidential and not to use it for purposes other than participation in the relevant selection procedure, for a period of 2 years from its disclosure.
13.2. The confidentiality obligation under Art. 13.1 does not apply to information that is or becomes publicly available other than by breach of this obligation, nor to information which the Candidate is obliged to disclose on the basis of a legal obligation or a final decision of the competent public authority.
14. CHANGES TO THE TERMS
14.1. Jobiflow reserves the right to unilaterally amend these Terms to a reasonable extent, especially due to changes in the scope of the Services, technological development, or changes in legal regulations.
14.2. Jobiflow shall inform the Candidate of material changes to the Terms
14.3. by email to the address assigned to the Candidate's account or
14.4. through a notice displayed upon logging into the Electronic System,
14.5. no later than 30 days before the changes take effect.
14.6. Minor adjustments, such as correction of typos, formatting, or clarification of the text, which do not change the rights and obligations of the Parties, may be made without prior notice.
14.7. If the Candidate does not agree with the changes, the Candidate is entitled at any time before they take effect to cancel their account free of charge in accordance with Art. 12.1 of the Terms. If the Candidate continues using the Electronic System after the amended Terms take effect, this shall be deemed acceptance of the amended Terms.
15. FINAL PROVISIONS
15.1. If any provision of these Terms is or becomes invalid, ineffective, or unenforceable, this shall not affect the validity, effectiveness, and enforceability of the remaining provisions of the Terms.
15.2. The Candidate is not entitled to assign rights and obligations under the Agreement to a third party without the prior written consent of Jobiflow. Jobiflow is entitled to assign rights and obligations under the Agreement to a third party (e.g. in connection with a merger, acquisition, or sale of part of the business), of which it shall inform the Candidate in advance; this does not affect the Candidate's rights under Art. 12.1 of the Terms.
15.3. In the event of a conflict between these Terms and the Personal Data Processing Policy, the Personal Data Processing Policy shall prevail with respect to the processing of personal data. In the event of a conflict between the Slovak language version of the Terms and any translation, the Slovak version shall prevail.
15.4. These Terms together with the Personal Data Processing Policy and the Cookies Policy constitute the entire agreement between Jobiflow and the Candidate regarding the subject matter hereof and supersede all prior oral or written agreements on the same matter.
15.6. These Terms are valid and effective from 14. 7. 2026.
