Consent to undergo an interview through an AI avatar and to automated percentage evaluation of answers

Company [Client's business name], with registered office at [address], Company ID: [Company ID] (hereinafter referred to as the “employer”), as the controller of your personal data, offers you the opportunity to complete the first round of the selection process for the position [job title] via an AI avatar on the Jobiflow platform, operated by Jobiflow s. r. o., Dlhé Nivy 420/90, 019 01 Ilava, Company ID: 57 430 501, which acts as the employer’s processor in this processing.

Please note that during the interview you will communicate with artificial intelligence, not with a physical person. The process is as follows:

the avatar will ask you questions prepared in advance by the employer,

an audio-visual recording of your answers and a textual transcript of it will be made, and

the system will automatically compare the content of the transcript of your answers with the employer’s model answers,

The result of this interview is a percentage match score. The system evaluates exclusively the content of what you say. It does not analyze your face, voice, facial expressions, tone of speech, fluency of speech, emotions, or any other biometric or behavioral characteristics.

The match score may significantly affect your progression to the next round of the selection process, therefore, in accordance with Art. 22 GDPR, we ask for your explicit consent and guarantee you the following rights: no decision on your rejection will be made solely automatically without review of your response by a physical person of the employer; you have the right to request human review of the result at any time, to express your own opinion on it and to challenge the result, by email at [employer contact] or through the Jobiflow platform; and you have the right to request an explanation of how the evaluation affected the outcome of your selection process.

Participation in the AI Avatar Interview is completely voluntary. If you do not give consent, you will undergo the first round of the selection process in an equivalent form without the use of artificial intelligence ([to be filled in by the Client: e.g. video call or in-person interview with a recruiter / written answers assessed by a recruiter]), and this choice will not have any negative impact on the assessment of your candidacy.

The legal basis for processing is your explicit consent pursuant to Art. 6(1)(a) and Art. 22(2)(c) of Regulation (EU) 2016/679 (GDPR). The following will be processed: audio-visual recording of the interview, its transcript, percentage match score, and technical metadata. Access to them will be granted exclusively to the employer and Jobiflow s. r. o. as its processor, or to subprocessors listed in the Jobiflow Personal Data Processing Principles. The recording and transcript will be deleted no later than 6 months after the end of the selection process. You may withdraw your consent at any time by email to [employer contact] or to info@jobiflow.com, without affecting the lawfulness of processing prior to withdrawal; after withdrawal, the recording and transcript will be deleted without undue delay. You also have the right to access the data, rectify it, erase it, restrict processing, data portability, and the right to lodge a complaint with the Slovak Data Protection Authority (Hraničná 12, 820 07 Bratislava, https://dataprotection.gov.sk). A data protection impact assessment has been carried out for this processing; further information is available in the Jobiflow Personal Data Processing Principles and from the employer.
